Bayer’s Glyphosate Granted Essential Status Under U.S. Defense Production Act

The U.S. government has granted glyphosate, the herbicide sold by Bayer, a special status. President Donald Trump has incorporated the production of glyphosate-and the extraction of the necessary phosphate mineral by Bayer-into the Defense Production Act (DPA), according to Handelsblatt citing U.S. industry sources. The White House confirmed on Wednesday evening that Trump signed the relevant regulation.

This action designates glyphosate availability as essential to U.S. security and independence, covering food, industry and defense. The DPA, in force since 1950, is meant to protect U.S. resources during crises.

By doing so the government aims to secure a reliable supply of the herbicide. It can require Bayer to prioritize securing national stockpiles in its production and to expand output. In return, Bayer will receive extensive support and protection for its manufacturing-partly extending to product‑liability matters.

Inclusion in the DPA could be a decisive move for Bayer to manage litigation risks faced by glyphosate users in the United States. This comes alongside a recently agreed settlement with plaintiffs’ attorneys and an upcoming Supreme Court decision.
