DAV Criticizes Justice Reform, Demands Free Legal Aid for Wrongfully Imprisoned

The German Bar Association (DAV) has criticized the latest draft proposal for reforming compensation for detention and is calling for the provision of free initial legal consultations for those unjustly incarcerated. The DAV noted that a comparable regulation is missing from the plan presented by Justice Minister Stefanie Hubig (SPD), as reported by the “Neue Osnabrücker Zeitung.” While the coalition government originally included a provision for free legal advice in an earlier draft-designed to encourage affected individuals to assert their claims without hesitation-this key element has since been dropped.

Despite this criticism, the DAV welcomed specific changes in the detention compensation draft. According to the proposed legislation, individuals imprisoned without cause will now receive €100 per day, an increase from the previous rate of €75. The association explicitly endorsed this improvement, having advocated for higher daily rates for years. Furthermore, the DAV praised the planned abolition of the current “degrading and cynical” rule that mandates deducting costs and accommodation from the compensation sum.
