Frankfurt Court Dismisses Mandatory Prosecution Request Over Fatal SWAT Operation

The High Court of Frankfurt am Main dismissed an application seeking a judicial decision concerning a fatal SEK (special police unit) operation in the Frankfurt train station district. The court announced this ruling on Tuesday, with its 7th Criminal Division making a final decision on the lawsuit‑enforcement proceeding related to the August 2022 police action.

During that operation, the applicant’s brother was killed by gunfire from a SEK officer. The man had taken refuge in a hotel room after threatening two prostitutes; he was intoxicated and armed with a knife and a purported pistol. Frankfurt prosecutors, after extensive investigations, had closed the case against the officer, concluding the shooting was justified as a matter of self‑defence.

The brother of the deceased challenged the termination of the case and questioned the alleged knife attack, arguing that the fatal shots were fired even though the victim was already on the floor. The High Court found no flaws in the prosecutor’s investigations and rejected the application. The decision is final and cannot be appealed.
