Investigation Into Former Health Minister Jens Spahn Over Mask Purchases Dropped by Berlin Prosecutor’s Office

The Berlin Attorney General’s Office announced Monday that it has closed the case against Union faction leader Jens Spahn (CDU) over mask purchases made during his tenure as federal health minister. The case was dismissed without further investigation. Since early June 2025, more than 170 criminal complaints have been lodged against Spahn, mainly concerning the acceptance of benefits and embezzlement. The complaints were initially logged as pending investigations because, as a member of the Bundestag, Spahn enjoys parliamentary immunity. To assess the allegations, the prosecutor’s office relied on the expert report of Margaretha Südhof and documents from the Federal Court of Auditors. Those reports were examined particularly with respect to direct contracts, the appointment of a logistics company, and the “open‑house” procedure at the Federal Ministry of Health. The preliminary criminal investigation found no sufficient factual grounds to substantiate a crime, leading the prosecutor’s office to discontinue the proceedings.
