The political plans of The Left party to nationalize large housing corporations have encountered considerable skepticism among constitutional and legal scholars. Ulrich Battis, a specialist in state law, told the “Rheinische Post” that there are milder, and most importantly, more effective alternatives. He stressed that the process of nationalization alone does not result in the creation of new homes. Battis added that attempting this measure would almost certainly fail in court, characterizing the action as neither appropriate nor feasible.
While acknowledging that actions within the constitutional framework are possible, the emeritus professor from Humboldt University Berlin cautioned that any measures must always remain proportionate. He further argued that the fundamental issue is the shortage of housing, rather than the current legal structure. This commentary comes as The Left, following its victory in the Berlin State Parliament election, has stated its intention to take over control of major real estate conglomerates within the city.
