Doubts raised by the CDU/CSU parliamentary group regarding the suitability of Frauke Brosius-Gersdorf as a candidate for the Federal Constitutional Court have been reiterated by Digital State Secretary Philipp Amthor. Speaking to RTL and ntv, Amthor cited a deeper discussion surrounding her perspectives on the concept of human dignity as the primary source of concern.
The CDU, as a Christian democratic party, maintains a fundamental principle of not distinguishing between lives with and without human dignity, a conviction shared by many members of the Union factions, according to Amthor. He refrained from commenting on whether this criticism would definitively preclude Brosius-Gersdorf’s potential election.
Amthor expressed support for the position taken by parliamentary group leader Friedrich Merz, who characterized the postponed election as a minor setback. He dismissed claims that the postponement has compromised the Constitutional Court’s functionality or rendered the government unable to act effectively. “The Federal Constitutional Court remains fully operational and this government is also able to govern” Amthor stated. Negotiations with the SPD will now proceed within a structured process. He underscored that the situation does not constitute a crisis.
Furthermore, Amthor defended the actions of parliamentary group leader Jens Spahn in relation to the election proceedings. He asserted that Spahn accurately assessed the circumstances, noting that the postponement reflects a profound understanding of the sentiment within the parliamentary group.
