The Bamberg Higher Regional Court has upheld the dismissal of a pain and suffering lawsuit brought by the mother of Peggy K., a victim of homicide. In a statement released Thursday, the court affirmed that the plaintiff failed to provide sufficient evidence demonstrating the defendant’s involvement in transporting her daughter’s remains to a forest in Thuringia. The court found no legal errors in the evidentiary assessment conducted by the Hof Regional Court.
The Higher Regional Court specifically noted that a partial confession made by the defendant during the criminal proceedings could not be considered within the civil lawsuit. This confession was determined to have been made under duress, contained internal inconsistencies and included objectively inaccurate information. Critically, the court found it lacked details demonstrating specific knowledge of the act itself.
The appellate ruling is not yet legally binding. The original lawsuit was previously dismissed by the Hof Regional Court in June 2024.
