RBB’s Challenge to Broadcasting Treaty Fails in Court

Germany’s Federal Constitutional Court has dismissed a complaint filed by public broadcaster Rundfunk Berlin-Brandenburg (RBB) concerning provisions within a state treaty agreed upon by the states of Brandenburg and Berlin in 2023.

The court announced Thursday that the challenged regulations do not violate RBB’s broadcasting freedom and do not fail to meet constitutional requirements for the structure of public service broadcasting.

The complaint targeted the ratification laws for the state treaty, which establishes a new legal framework for RBB. The broadcaster argued that various provisions within the treaty infringed upon its broadcasting freedom, including the introduction of a directorate alongside the existing executive board and the mandated minimum number of regional offices and studios. However, the court did not uphold this argument, as detailed in its decision issued July 23, 2025 (Case No. 1 BvR 2578/24).
