The administrative court in Hanover rejected an emergency application filed by the AfD against the designation of the state association in Lower Saxony as a subject of significant observation. This decision was announced on Monday. The Lower Saxony Constitution Protection Agency had classified the state association as a suspected entity following a phase of intelligence gathering that began in May 2022. Subsequently, it publicly announced in February 2026 that it was escalating its status to that of an object of significant observation. This designation was based on a 212-page expert report, which compiled evidence of constitutional hostility by AfD Niedersachsen from publicly available sources. The court found “sufficient facts” indicating attempts to undermine the free democratic constitutional order. These alleged endeavors included “agitations against central fundamental principles” such as human dignity and the principle of democracy. The decision is not yet legally binding, and the AfD retains the right to appeal to the Higher Administrative Court of Lower Saxony.
