Di Fabio: Foreign Voting Rights Unconstitutional at State Level, Permitted Locally

Former Federal Constitutional Court judge Udo Di Fabio has ruled that the proposal put forward by a potential coalition government in Berlin, which seeks to introduce voting rights for foreigners at the regional level, is unconstitutional. Di Fabio stated to the TV channel “Welt” on Thursday that while such a measure could be introduced at the municipal level, it is not permissible at the state level-meaning within the scope of the federal and state governments. He emphasized that in these higher bodies, “the German people” or the “constituent peoples” of the states must vote, and to do so, one must be a German citizen, “meaning holding a German passport.” The preliminary policy paper put forth by the Red-Red-Green coalition plans to grant both active and passive voting rights to all foreigners who have resided in Germany for five years, applying this right both at the municipal and state levels.
