Elif Eralp, the leading candidate of the left-wing faction in Berlin, is reportedly preparing legal action against the news magazine “Spiegel” following the publication of confidential internal notes from an interview. According to Politico, who cited members of the Left Party, the party intends to file a formal complaint with the German Press Council.
The central conflict revolves around whether Spiegel was authorized to release notes that were clearly not intended for public circulation and were part of the authorization process. The situation has been complicated by the fact that Eralp had explicitly warned in these internal documents about potential dangers to herself and her family.
From a press law perspective, the case presents a complex balancing act. It pits the public’s right to information regarding the statements of a prospective head of government against the essential protection of Eralp’s personal rights and physical security. Spiegel, however, defended its decision to publish the material by arguing that the political weight of the remarks justified the release.
