BAGW Hails New Tenancy Law Reforms as Key to Preventing Homelessness in Germany

The Federal Association for Homelessness Assistance (BAGW) expects that the proposed amendments to tenancy law will strengthen protection against homelessness.

Managing Director Sabine Bösing told the Redaktionsnetzwerk Germany that the legislation will clarify that settling rent arrears covers both forms of termination-extraordinary and the alternative ordinary termination. “Only in this way can unnecessary terminations and court disputes be avoided, thereby preventing homelessness proactively” she said.

Bösing was referring to the planned changes to the so‑called grace‑period regulation. Under these changes, tenants who receive an ordinary termination for rent arrears can once fully cancel it by paying the delinquent rent within a specified window. “It should not happen that tenants who have cleared their debts live in uncertainty about whether their tenancy actually continues” Bösing added.

Thus, the BAGW’s director counters the view of Kai Warnecke, president of the Homeowners Association Haus & Grund, who had previously argued that extending the grace period to ordinary terminations would provide no protection against homelessness.
