Former SPD chairman Franz Müntefering is advocating for a ban procedure against the AfD party, stating to the weekly magazine Die Zeit that he supports initiating proceedings so that the matter can be reviewed by the highest court. He criticizes the party, particularly pointing to its positions regarding foreigners and migrants, arguing that these positions violate Article 1 of the Basic Law, which enshrines human dignity as a constitutional principle. The SPD politician, former labor minister, and vice-chancellor accused the AfD of attempting to nullify this principle, adding that by doing so, they are undermining the fundamental idea of democracy. According to the SPD politician, democratic parties not only have the right to file such a ban request, but also a duty to do so, as the Constitution serves as a guiding principle for their actions. The constitution is clear that the banning of political parties is an explicit instrument of a resilient democracy. Müntefering’s view is that the Federal Government, the Bundestag, and the Bundesrat should coordinate among themselves regarding who should apply for the ban proceedings before the Federal Constitutional Court. However, it is the court that ultimately makes the decision. On a separate note, Müntefering sharply rebuffed his party friend Torsten Albig, who had questioned the “firewall” against the AfD, advising him: “No, that is not recommendable. Nor is it necessary. Doing that will get you in the headlines, but those stories usually have only a short duration”.
