Wolfgang Niedecken, the frontman of the band BAP, has publicly advocated for the review of a potential party ban against the AfD. Speaking to the “Tagesspiegel”, Niedecken stated that the issue of banning the party “must be realistically considered”. He sharply criticized the AfD, adding that the group fails to present any genuine new options, only amplifying negative sentiments, and offering zero solutions.
The Cologne musician has a long-standing reputation for taking a public stand against far-right extremism throughout his career. Reflecting on the continued relevance of the BAP song “Kristallnaach” originally released in 1982, Niedecken expressed his profound concern, stating that he would prefer the song to be considered outdated. Furthermore, he mocked the behavior of AfD members, who he accused of “whining” every time a member of the Green party speaks in the federal parliament, drawing unfortunate comparisons to the Weimar Republic.
In legal context, Article 21 of the Basic Law dictates that parties are considered unconstitutional if their goals, or the conduct of their members, aim to impair or abolish the constitutional democratic basic order, or if they endanger the existence of the Federal Republic of Germany. While the ultimate ruling on unconstitutionality rests with the Federal Constitutional Court, Niedecken pointed out that the court cannot act independently; a formal review request must first be submitted by the Bundestag, the Bundesrat, or the Federal Government.
