Germany’s Justice Minister Criticizes Handling of Court Candidate

The Federal Justice Minister, Stefanie Hubig (SPD), has strongly criticized the handling of the Federal Constitutional Court candidate, Frauke Brosius-Gersdorf.

Speaking to the “Süddeutsche Zeitung” Hubig described the manner in which Brosius-Gersdorf has been targeted as “an incredible development” emphasizing the “extreme personal attacks” she has faced. Hubig warned that such campaigns risk deterring qualified individuals from seeking positions, a situation the government cannot afford.

Hubig characterized the actions of the conservative opposition as “more than regrettable”. Addressing the ongoing situation within the governing coalition and future procedures, she stressed the importance of reaching decisions swiftly, “in the interest of all involved”. She underscored the significance of the position of a judge at the Federal Constitutional Court as one of the most vital roles within the state.

Hubig expressed concern for all three candidates, stating that it is crucial they not suffer further, preventable damage. The dispute surrounding Frauke Brosius-Gersdorf led to the removal of the elections for Ann-Katrin Kaufhold and Günter Spinner from the Bundestag’s agenda.

Referencing the Bamberger Archbishop Herwig Gössl, a prominent and vocal critic of Brosius-Gersdorf who later retracted his comments citing misinformation, Hubig commented that, irrespective of individual actors, the practice of publicly criticizing individuals without due diligence and subsequently correcting those assessments is “inappropriate” and detrimental. She called for increased quality and care in public debate, urging a focus on constructive dialogue rather than adversarial pronouncements.

Hubig concluded by advocating for a fundamental shift in how candidates are treated, recognizing their crucial willingness and commitment are essential, not only for the Federal Constitutional Court, but also for numerous voluntary applicants seeking local government positions.
