Renewable Energy Approvals At Risk Urgent Action Needed

The head of Germany’s Federal Administrative Court, Andreas Korbmacher, has urged swift action from the Bundestag to establish a follow-up regulation to an EU emergency ordinance set to expire on June 30th. The current ordinance significantly streamlines approval processes for renewable energy projects.

In remarks to the “Handelsblatt” newspaper, Korbmacher expressed hope for a rapid implementation of the extension, noting that a draft already existed but was stalled following the recent political difficulties within Germany’s governing coalition. He indicated the proposal would need to be reintroduced to parliament.

Without a continuation of the simplified procedures, Korbmacher warned of a bifurcated system emerging. “We will have two types of approval processes” he stated, “those submitted before June 30th, 2025 and those applied for afterwards”. Projects submitted before the deadline will continue to benefit from the expedited process, while those submitted later will revert to standard, more lengthy procedures.

“This is not a good situation, that’s certain” Korbmacher concluded, highlighting the potential for inconsistency and hindering the continued expansion of renewable energy capacity. The call for action underscores the importance of maintaining regulatory clarity for investors and developers in Germany’s crucial energy transition.
