The Wiesbaden Administrative Court ruled this Wednesday that the Hessian State Office for the Protection of the Constitution is authorized to classify the AfD’s Hessian chapter as a right-wing suspect case and monitor it. Concurrently, the court determined that the State Interior Ministry and the authority in question violated regulations by informing the public about the monitoring of the AfD in 2022.
Earlier, in an emergency procedure in September 2025, the court had already dismissed the appeal filed by the AfD leadership. At that time, the court stated that the prerequisites for classification as a suspect case-specifically, concrete evidence of efforts directed against the democratic and liberal constitutional order-were present among the AfD.
While recognizing the scope of the AfD’s freedom of speech, the court concluded that the party supported an “ethnic concept of the people”. The findings noted that there are sufficient statements criticizing the human dignity of foreigners, particularly asylum seekers, by labeling them as ethnically “foreign”. Furthermore, the court found indications of discriminatory unequal treatment between German citizens based on whether or not they have a migration background. It was also stated that the AfD seeks to fundamentally undermine public trust in the representatives of the Federal Republic of Germany, thereby casting doubt upon the liberal democratic basic order in its capacity as a democracy and a state governed by the rule of law.
